社民党に物申す：社民党さん、普天間も「県内移設」一転了承ということはないでしょうね！？
「社民党は３日夕、政審全体会議を国会内で開き、民主党がまとめた官僚答弁を禁止する国会法改正案原案に関し、基本的に了承した。小沢一郎幹事長から先月３０日に改正に非協力的だと批判され、わずか３日間で姿勢を一変させた格好だ」（東京新聞 2009年12月3日）。

上記東京新聞記事にいう民主党小沢幹事長の社民党批判とは次のようなものでした。
「小沢氏は、１１月１６日に社民党に改正案を打診して以降、同党から返答がないとしたうえで、『非常に残念だ。私は（０６年に）代表に就任して以来、参院選、衆院選という二つの大きな選挙を担当したが、非自民で（当時の野党の）みんなの力を合わせて政権交代をと（目指した）。特に社民党には、選挙区の割り当てやらいろんなところで積極的に協力してきたつもりだ』と過去の話まで持ち出して『社民批判』を展開した」（読売新聞 2009年11月30日）。

社民党はこの時点まで、「小沢氏の目指す国会改革について、『法律を作って役所の答弁を禁止することまでは必要ない』（福島党首）と一貫して否定的」（同上）な立場でした。

それが上記の小沢氏の恫喝を受けた翌日の１日朝、社民党側から民主党に官僚答弁を禁止する国会法「改正」案の説明を要請します。社民党議員の大勢はこの時点まではまだ「（内閣法制局長官は）憲法の番人だ。今まで通り答弁させるべきだ」などと民主党の国会法改正案に反対の姿勢をみせています（報道例１）。が、同党の「重野幹事長は法改正に反対していたが、説明を受けた後、記者団に、『当初受け止めたものと比べて、距離はかなり縮まった』と述べ、柔軟に対応する考えを示唆」（報道例２）します。

そうして３日夕に同党政審全体会議を開き、これまでの官僚答弁を禁止する国会法「改正」案反対の立場を賛成（了承）の立場に転じます。まさに「小沢一郎幹事長から先月３０日に改正に非協力的だと批判され、わずか３日間で姿勢を一変させた」（東京新聞）わけです。
社民党さん。
あなた方の党はこれまで内閣法制局長官の答弁禁止を含む国会法の「改正」は、「憲法を大事にするわが党からすれば、政府から独立して憲法観を表現する法制局長官（の答弁）は必要だ」（重野幹事長、時事通信 2009年11月12日）、「政治主導で憲法解釈が変更される」（同）恐れがある、「『解釈改憲』に歯止めがかからなくなる」（時事通信 2009年11月28日）、「『官僚答弁の禁止』で喜ぶのは、政治家ではなく官僚の方ではないか。（略）すべての言い訳を政治家にさせ、嘘の答弁を演出して後日判明しても知らんぷりをしていられる」（保坂展人のどこどこ日記 2009年10月3日）などとして明確に反対の立場をとってきたはずです。
それがどうして民主党小沢幹事長の恫喝があるや否や右から左へと態度を１８０度豹変させるのでしょう？ あなた方の党は自らの政党の理念やその政党に属する議員、構成員ひとりひとりの人間的節操、あるいは政治的節操よりも、権力集団の一員となってなんとかその利権の配分のおこぼれにあずかりたい、という思い、執念の方が一段と勝る政党という名を冠しただけの単なる利権屋集団にすぎないということでしょうか？ そうではないでしょう？
民主党の小沢幹事長が提起した非民主的な国会法「改正」案に反対、というあなた方の党の初心の態度表明は正しいのです。小沢幹事長の提起する同国会法「改正」案のどこが、そして何が非民主的なのか？ この点について下記におふたりの憲法研究者の論を紹介し、あなた方の党の初心の態度表明の正しさを第三者的に補完してみます。
おひとり目。浦部法穂さん（神戸大学名誉教授／弁護士）。浦部さんはまず官僚答弁禁止問題でその問題の焦点になっている内閣法制局自体の問題性を次のように述べます。
「（内閣法制局の）憲法解釈は、これまでの自民党政権の基本政策に沿った形で行われてきた。自衛隊を合憲とする論理も、アフガン戦争やイラク戦争への自衛隊派遣を合憲とする論理も、すべて内閣法制局の示した憲法解釈による。内閣法制局は、いってみれば、憲法をねじ曲げてきた「元凶」でさえある。内閣法制局の憲法解釈は、これまで、お世辞にも正当に行われてきたとはいえない」
それでも、と浦部さんは言います。
「それでも、内閣法制局の存在意義は、その時々の政権の思惑に合わせてご都合主義的に解釈を変えるのでなく、これまでの解釈との整合性を保って『純粋法理論』的な『装い』を施す（一応法律論らしい論理を示す）ところにあるのであって、そのことが、時々の政権の『突出』に一定の歯止めをかけてきた」。「内閣が『やりたい』と言っても『法理論的にできない』と言える機関の存在とその判断を政府が尊重するという政治慣行によって、権力制限規範としての憲法の規範的意味が、かろうじて、まさに首の皮一枚で、残ってきたともいえるのである」。「小沢幹事長や平野官房長官の発言は、この『首の皮一枚』をも切り落としてしまおうとするものにほかならない。憲法解釈を『政治判断』で行うというのは、『政治』の都合のいいように憲法を解釈するということである。時々の『政治』の都合でどうとでも解釈できるようなものは、もはや『憲法』とはいえない」（憲法解釈も「政治主導」？ 「法学館憲法研究所」2009年11月12日）

もうおひと方。上脇博之さん（神戸学院大大学院教授）。上脇さんも浦部さんと同様にまず内閣法制局自体の問題性を次のように指摘します。「私は、これまで内閣法制局の憲法解釈が日本国憲法の立場を正しく捉えて『解釈』してきたとは思っていない」。
が、それでも、と上脇さんも内閣法制局の答弁の重要性を次のように述べます。
「が、それでも、改憲政治家の憲法『解釈』よりも、まだマシであると思っている。正確に言えば、内閣法制局の憲法『解釈』は危険であったが、改憲政治家の憲法『解釈』はもっと危険である」。「国会審議において官僚答弁を禁止するとして、憲法解釈について内閣法制局の答弁を禁止すれば、改憲政治家である大臣が憲法『解釈』を行うことになるから、これまで内閣法制局が違憲であると解釈してきたもの（自衛隊の集団的自衛権行使や、国連安保理決議がある場合の自衛隊の武力行使など）を『合憲』であると『解釈』してしまう危険性がある。言い換えれば、（内閣法制局の答弁禁止は）官僚（内閣法制局）がつくってきた『歯止め』さえ取っ払ってしまい、立憲主義を骨抜きにしてしまう危険性があるのである」（内閣法制局長官よりも恐ろしい改憲政治家の憲法「解釈」 「ある憲法研究者の情報発信の場」2009年10月10日）

社民党さん
上記に見たように小沢氏の提起する国会法「改正」案に反対、というあなた方の党の初心の態度表明は憲法学の研究者からも支持される正当な態度表明です。それを１８０度転換させるあなた方の党の今回の態度豹変はどのようにも論理的説明がつかないものです。あなた方の党が政党という名を冠しただけの利権屋集団というのでもない限り。あなた方の党は、保守的な党との与党連立を重視するあまり自らの党のレーゾン・デートル（存立根拠）ともいうべき理念を簡単に放擲する表明をして当時の社会党を解体にまで到らせた社会党村山党首時代のあまりにも苦々しい経験をいまだに昨日のことのように覚えていらっしゃるはずです。あなた方の党は、この苦々しい経験をいま一度繰り返されるおつもりでしょうか？ あなた方の党が今回のこの暗愚な態度の豹変の重大性に一日も早く気づかれることを私としては祈るばかりです。
さて、話の続きはまだあるのです。
沖縄の普天間基地の撤去問題に関する福島党首の「どっちつかず」（党幹部）の態度に党内の閉塞感が強まり、「党首交代論も浮上」（朝日新聞）してきた、という報道があったのは先月の２６日のことです。

こうしたのっぴきならない「党首交代論も浮上」してきたことから、福島党首は３日、鳩山内閣が普天間基地の辺野古移設を決めた場合は連立離脱も辞さない考えを示唆します（共同通信 2009年12月3日）。「４日告示の党首選をにらみ、普天間問題に関する福島氏の取り組みが不十分との党内の不満を抑える狙いもあるとみられ」（同）ています。

この福島党首の記者会見での「連立離脱も辞さない」表明を受ける形で沖縄県選出の照屋寛徳衆院議員が同３日に記者会見し、不出馬の意向を明らかにし、同４日に福島氏が社民党党首に再選されます（朝日新聞 2009年12月3日、同４日）。

社民党の問題は、この党首交代騒ぎと機を一にするように上記の国会法改正案に対する同党としての態度も反対から一転了承へと１８０度豹変させていることです。そのなにが問題かといえば、同党のレーゾン・デートルともいえる憲法上の問題にも関わってくる国会法改正案への態度の１８０度の転換さえかくも容易に転換するのであれば、「鳩山内閣が普天間基地の辺野古移設を決めた場合は連立離脱も辞さない」という福島党首の言明も信頼するに足ることにはならないだろう、ということです。事実、対立候補の社民党首選出馬の動きがなければ、福島党首は「連立離脱」を決して口にしなかっただろう、というメディアの指摘もあります。福島党首の「連立離脱」表明は自らの意志の表明というよりも、対立候補封じのための策という側面の方が強かったのではないか、という指摘です。
また、この点に関して気になるのは、社民党の福島党首が国民新党の亀井代表と「来年夏の参院選までは移設先を決めるべきでない」という点で合意したかのような報道があることです（首相に亀井氏「参院選まで普天間決めるな」 社民と共闘（朝日新聞 2009年11月28日）。

この点について「＜佐藤優現象＞批判」（『インパクション』第160号 2007年11月刊）の筆者の金光翔さんは次のような指摘をしています。
「社民党は、普天間基地移設問題の年内決着に反対している。鳩山首相のグダグタぶりが、落としどころが決まった上でのパフォーマンスでない保証もないのだが、少なくとも以下のことは言えるだろう。決着延期で社民党と共闘する国民新党の亀井静香のように、参議院選まで決めなくてよい、と言うのであれば、民主党は、公約違反の批判を浴びることなく、参議院選を迎えることができることになるし、しかも保守的な支持層に対しては、決着の遅延の責任は社民党に押し付けることができるのだから、民主党にとっては一石二鳥だ」（「社民党がいるからこそ民主党の横暴が抑えられている？」私も話させて 2009年12月5日）

上記の金光翔さんの指摘は私は的を射た指摘だと思います（ただし後段の「『安保容認・県外施設』の立場である大多数のリベラル・左派」という金さんの認識は賛成できません。「リベラル」はともかくとして「安保容認」の「左派」が「大多数」だとは私は思いません）。普天間基地撤去問題は、民主党のこの問題についての対応だけでなく、連立与党の一員としての社民党のこの問題に対する対応も注意深く見守る必要があるように思います。同基地撤去を真に実現するためには、その注視は、同基地撤去の実現を願う市民としての義務というべきものでもあるように思います。

元々脱自衛隊でなかったのか、それが民主党と組んでアメリカ軍の駐留問題に賛成する気になっていますよね。不思議な党ですねだから伸びないんですよ、昔みたいに曖昧なことばっはりしているから誰も賛同しませんよ。脱民主党で平成の脱税王、不動産王に突っ込んだら、首相首相の辻元議員さんどうなっているの、笑わせるよ。自民党の時は不正を追及していた癖にいまは、与党になったら追求もしないふざけるな、お前らの党もろくな議員いないよ。国民騙すなよな。
